Re: Public Summary of Investigative Findings Regarding Director Kelly Gregg’s Unauthorized District Property Use and Related Financial Interest

 

On or about September 10, 2026, the Hesperia Recreation & Park District (District) retained Leal ▪ Trejo, A.P.C. to investigate allegations that Director Kelly Gregg authorized a private school to use District-owned property without documented Board approval while his company, True Liberty Protection Services (TLPS), provided security services to the school. The investigator reviewed written information from a school representative, correspondence, financial-disclosure records, District policies, and applicable law. The report states that Director Gregg was invited to interview and did not respond.

Key Findings Reported

According to the report, the Academy used District property for student pickup and traffic circulation from approximately July 2022 through August 2026. The report states that the use lacked documented Board approval, a facility-use permit, payment to the District, and a written agreement. Based on the written information reviewed, the investigator attributed the authorization to Director Gregg, who was responsible for security protocols under TLPS’s arrangement with the Academy. The Academy reportedly paid TLPS more than $1.3 million during the relationship. The report states that the District learned of the use in July 2026.

Legal and Policy Issues

The investigator identified potential issues under laws and District policies concerning use of public resources, financial disclosures, facility use, governance, and gifts of public funds. The report also identified possible embezzlement and extortion issues for review by agencies with appropriate authority. These are the investigator’s assessments, not adjudicated findings or determinations by a public agency.

District Exposure and Recommendations

The report identifies potential premises-liability, negligence, defense cost, and related financial risks arising from the absence of a written use agreement, indemnification provisions, and documented insurance protections. The investigator recommended preserving relevant evidence; referring the matter to the California Fair Political Practices Commission, the San Bernardino County District Attorney, and the California Attorney General for independent review; and evaluating recovery of the fair value of the property use and any resulting losses.
